to his company at the expiration of his leave
of absence. He was at that time confined
to his bed, and under my care.

Capt Stears of your Regt
has again come under my charge, and I
have put a decided "veto" upon his return
to Camp to enter upon his Military Duties.
In view of the present condition of his
health and the fear that if neglected, the
injury to his brain may become permanent.
I have advised him, and with great diffi-
culty have obtained his consent, to offer his
resignation, and return home, and place
himself under proper Medical care
with great respect

The undersigned now holding the position
of Capt. of E Comp 14th N.Y.S.M. now in the service
of the U S most respectfully tenders His resig-
nation His health not being sufficiently good
to endure the hardship and fatigue of Camp
life as the accompanying papers set forth
The undersigned would respectfully
represent that He is not amenable to Court
Martial or liable to arrest and that He
has turned over all Books, Papers, Monies &c
to the proper Officer authorized by law
to receive the same.
Your petitioner most respectfully
requests that His discharge be unconditional
and immediate
